Adjourn • • Cedar Falls Planning and Zoning Commission Regular Meeting August 21, 1991 City Hall 220 Clay Street MINUTES The Cedar Falls Planning and Zoning Commission met in regular session on August 21, 1991 in. the. City mall Council Chamber. Chair Grimes called the meeting to order at 7:80 P.M. Roll call showed the following commissioners present: Bramblette, Brown, Grimes, Larsen, Meyermann, Ohl, Schilling.. Members, absent were: Barnes, Hunemuller, , Kira, Merner. . Department of Develop- mental Services staff members present were: Martin Ryan, mark Ripplinger and Al Schneck, City Engineer. 1. Mr. Grimes. asked for comments or corrections_ on the Minutes of the June 19 and July 17 regular meetings. Mr. Bramblette made a motion to approve the Minutes as submitted. Mr. Ohl seconded the motion. The motion was approved unanimously. 2. The first order of business was to conduct a public hearing regarding a request to rezone property at 1505 West First by Roger Palmer from C-1 to C-2, Commercial. Mr.. Grimes noted that a notice for public hearing has been publishedin the Waterloo Courier. The rules of the hearing were. explaine.d.and Mr. Grimes declared the hearing open. The first person to comment on the request was Mr. Jerry Jacobsen, legal representative of Mr. Palmer, who spoke in sup- port of the request. Mr. Jacobsen.sta.ted that. Mr. Palmer is closing the existing gasoline service station and has sold the property to someone intereste.d.in opening an auto repair busi- ness. Several neighborhood residents were present to speak against the rezoning request.. Mr. Walther, 128 N. Ellen, Mr. Wienands, 120 N. Ellen and Mrs. Albert Pollock, 1.19 N. Genevieve, all ex- pressed concerns about the negative impact of C-2 zoning upon the neighborhood and property values. They were apprehensive about the establishment of an auto repair business at the site. Mr. Wienands asked that a fence be installed at the north proper- ty line of the subject property. 1 • Following a brief rebuttal by Mr. Jacobsen, Mr. Grimes declared the hearing closed. Mr. Bramblette submitted the Planning Committee report which noted the various concerns expre.ssed.by the residents. However:, the Committee recommended.approval of the rezoning request. Mr. Larson made a motion to receive the Committee report. Mr. Ohl seconded the motion. The motion was approved unanimous-ly. Mr. Bramblette made- a motion to approve the rezoning request, C-1 to C-2. Ms. Brown seconded the motion. The motion. was. approved with 4 ayes (Brambletter Grimes, Larson, Schilling), 3 nays ( Brown, Meyermann, Ohl) . 3. The second order of. business was consideration of a. proposed RP District site plan amendment. from College Square Partners, Ltd. The proposed site plan. includes 62 apartment units for the College Square Elderly Village. Mr. Bramblette submitted. the Planning Committee report which noted insufficient parking provision and. concerns aboutlocal, inflow and. infiltration ( I & I) problems in. the sanitary sewer system. The. Committee recommended tabling the issue. pending submittal of a.revised site plan.showing adequate parking. Mr. Bramblette made a motion to.receive the committee report. Mr. Meyermann seconded the motion. The motion was approved unanimously. Mr. Bramblette made a motion to remove the matter off the ta- ble. The motion was seconded -by Mr. Meyermann.. The motion was approved unanimously. Mr. Tim Urban, representing the developers,- was present to sub- mit a revised site plan. The revised plan met parking require- ments as well as other site requirements. Mr. Urban commented. that a private engineer is evaluating mitigation options regard- ing. the I & I problem. Any remedies will be reviewed by the City Engineer prior to construction. Ms. Brown commented on the serious local flooding problems in the area and is concerned. about permitting new development. Following discussion Mr,. Bramblette made a: motion to recommend. approval of the site plan based on.staff recommendations regard- ing the I & I problem. The motion was seconded by Meyermann. The motion was approved with 5 ayes, 1 nay (Brown).. 2 • 4. The following agenda item was consideration of a request from Mr. James Walsh at 919 Oak Park Boulevard to vacate a por- tion of sanitary sewer easement adjacent to his property.. Mr. Ohl submitted the Platting and Streets Committee: report which noted -Mr. Walsh's desire for a portion of the easement, and the City's desire to retain..al.l of the easement... The committee recommended tabling the request. until Mr. Walsh can develop an acceptable proposal that the. City will approve. Mr. Larson made a motion to receive the Committee report. Ms. Brown seconded the motion. The motion was approved unanimously. Mr. Grimes introduced.a letter from Mr. Walsh which indicated. that he was preparing building plans and wantedd to discuss: op- tions with City staff. He requested that further consideration be suspended at this.time. Mr. Bramblette made a motion to table the easement vacation request. Mr.. Uhl seconded.the. motion. The motion was approved unanimously. 5. The next item was referral of. new agenda.items for future action. The following new agenda items were referred to the appropriate committees: 1. Right-of-way vacation, Mid America Savings Bank, refer to Platting and Streets Committee.. 2. Right -cif -way vacation, The Kookie People, refer to Platting and Streets Committee. 3. Subdivision ordinance revision, refer to Committee. 4. Ordinance amendment, Bed and Breakfast Inns.,,, Planning Committee. Planning refer to. Mr. Ohl made a motion to receive and refer each of the new agen- da items. The motion was seconded by Brown. The motion was approved unanimously. 3 • • 6. The next item was general discussion of two items: a. Bed and Breakfast Inns. b. Exotic animals as pets. A lively discussion was had regarding Bed. and Breakfast Inns. Several innkeepers were present. City Planner Martin Ryan was requesting that a new definition regarding bed and. breakfast inns be developed. After discussion it was the consensus of the Commission that new definition be investigated further. Commission members, were not quite so concerned about the prolif- eration of various types of animals as pets so long as they are not farm animals.. Commission members encouraged staff to contin.- ue enforcing the ordinance.in the manner practiced to date 7. Following discussion Mr. Bramblette made a motion to ad- journ. Mr. Ohl seconded the motion, The motion was approved. unanimously. The meeting adjourned at 8:40 P.M. Mrs. Palmer have submitted a request to rezone property at 1505 West 1st Street from C-1. to C-2. The property is currently occupied by Rogers Auto Service Gas Station. The Palmers wish to convert the existing gas station to an auto sales/repair business at the site. The property is located in a commercial district with numerous businesses. in the immediate vicini- ty. A C-2 zoning district lies immediately west of the property. The. proposed use will not dif- fer substantially from the current use on the site or other uses in the neighborhood.. The Schematic. Land. use Map indicates that commercial uses are appropriate for this area. the site is adequately served by all the normal municipal services. The Zoning ordinance requires that a six foot high screen (i.e.: fence, wall or plant material) be installed to screen commercial parking areas from abutting residential properties. Since an R-2 zoning district lies immediately to the north rezoning approval should stipulate: that minimum screening requirements be met by the property owners. 1 • C7 • Staf f Recommendation: The Department of. Partners Ltd.., Des Moines, Iowa Location: The proposed College Square Elderly Village is located south of College Square Mall on. Maplewood. Drive. The proposed site is located immediately east of the College Square Apartment Complex at 923 Maplewood Drive. Zoning: R-P, Planned Residential., was. originally approved for the site in 1971. The original approved_ site plan indicated 348 dwelling units on 17.94.acres, or a density of 19.4 units per acre. The R-P zoning district requires site plan review of all proposed major improvements within the district. Submitted site plans must be reviewed and approved by the Planning and Zoning Commis- sion and by the City Council... Floodplain: The subject property lies outside of the designat- ed floodplain. Municipal Services: The property has ready access to sanitary sewer., water, and other normal utilities. The owners will be responsible for any relocation/ extension costs of existing utility lines such as water and. gas. The City Engineer has reported that in 1.973 exist- ing sanitary sewer was deemed adequate for the proposed development of College Square Apartments based upon the approved populationdensity of. 19.4 units per acre. However, since that. time the integrity of the: sanitary sewer lines in the area, has been reduced by inflow and infiltration (I&I) problems During heavy rainfall the sani- tary sewer line is flushed with water which over- loads the local system.. The City Engineer recom- mends that the I&I problem be addressed prior to development on the site. The storm sewer system, which was upgraded in 1975, is adequate to accommodate the proposed development.. On site storm water detention, plans will be submitted at thetime of construction. 7 • • • Staf f Analysis: The submitted site plan proposes a multi -family development consisting of sixty (60) one bedroom apartments in eight separate buildings. A commu- nity building measuring 1400 sq.ft. is also pro- vided on the first floor of one multi. -family unit. The proposed development is designed. with the intent of providing affordable housing for elderly persons. The College Square Corporation (Jim urban, Presi- dent) also manages the existing College Square apartments. which.contains 80 housing units prima- rily occupied by subsidized elderly tenants.. An existing "waiting list" of over 100 eligible tenants seems to justify the proposed addition. The housing is subsidized by the Federal. Section 8 Housing Program and the Iowa Finance Authori- ty. The "targeted" tenants will be elderly. However, non -elderly tenants will be considered if they meet income guidelines for receiving subsidized housing. The proposed site plan takes precedence over a similar plan submitted. and approved in May" 1990. At that time 1.28 multi -family units were proposed: on 7 acres at a density of 18.29- units. per acre. That plan did not materialize. The submitted_ site plan meets minimum zoning requirements pertaining to setbacks. However, the number of parking stalls provided (92) does not meet the minimum requirement of 97 stalls.. The zoning ordinance. requires. 1..5. parking spaces for each unit. of housing for elderly or handi- capped., and one. (1 ) parking stall for every 200 s . f . of gross floor area within the community center. The easement is thirty (30) feet wide with the sanitary sewer lying approximately in the center of the easement or approximately fifteen (15) feet of easement on either side of the sewer. Maintenance of the sewer will require that access to the north manhole be available to cleaning, televising and repair equipment. Should excavating to the sewer be necessary the entire easement area will be required for equipment and storage of excavated material. At an average depth of nearly twelve (12) feet exposure of the sanitary sewer will require the entire thirty (30) feet of easement -for excavation. At fifteen (15) feet plus, exposure at the South end will be extremely difficult to accomplish on the existing easement. The existing thirty (30) feet is hardly enough to provide proper maintenance t❑ the sanitary sewer line. Anything less would make it virtually impossible to provide adequate maintenance. It is recommended by the Public works Department that the request for vacation of a portion of the easement be denied. cc C.
